Old mortgage company still holding our escrow money after we sold the house, any legal ways to get back?

We sold our house on October 8th. Mortage company owes us our escrow money, and says they mailed it. It has not come and they say “they will check into it”. Is there any legal ways I can make these fools pick up their feet and give me my money already?

Hire an attorney! The reason they’re sitting on it is they have it invested short term and as long as they can hold you off the more they can make!
mortage mortgage
Yeah. Bring a bat and a Uzi, and problem solved.

It does take a little while to get a refund; however, I would write the request instead of calling them. If still no luck, get an attorney to write a letter demanding the refund.
Create a video blog…instantly.
I think the answerers are on the mark with an attorney, but I thought I’d add my two cents. I have found that I can -use- an attorney without paying for it. Nothing slimey, I just threaten or talk about my attorney and a lot of companies will step it up.
Not wild, “I’m going to call my lawyer!” … more sublte: “What address should I have my lawyer send the documents to?” … “and what is the company president’s name?” (or better yet, look his name up on their website and be ready: “and the president’s name is John Smith… correct?”)
Ask for the names of everyone you speak to. I do this before the end of the call - I say, “I’m sorry, but also, I’m keeping track of who I’ve spoken to for my lawyer.” I ask their name (some won’t give a last name) and I ask for their title and supervisor’s name. I act nice, almost sorry, “I know it’s a pain, but I need to have this info for him”… I never say he’s asked for it - cause he hasn’t. But they don’t need to know that.
You might start the call all calm - “I’m preparing to bring my attorney into this situation and I’m calling to clarify a few things before he contacts you. I wish it didn’t have to come to this - but your company isn’t making good on their end of our contract.”
Just sound serious, calm, and professional. See where it gets you. You might HAVE to bring a lawyer into it but give them a chance to make it right.

Be patient. It can take 30-90 days to be refunded. You mtg papers should have an explaination. Threating a lawsuit will only cause more delays.
